V/v Bắt giam trái phép Lê Anh Hùng đưa vào Trung tâm Bảo vệ Xã hội số 2 ở Ứng Hòa, Hà Nội

Thưa qúy Ngài,

Đài Quan sát bảo vệ các Nhà bảo vệ Nhân quyền (The Observatory for the Protection of Human Rights Defenders), là tổ chức liên đới với Liên Đoàn Quốc tế Nhân quyền (FIDH, International Federation for Human Rights) và Tổ chức Thế giới Chống Tra Tấn (OMCT, World Organisation Against Torture), cùng chung với Ủy ban Bảo vệ Quyền Làm Người Việt Nam (VCHR, Vietnam Committee on Human Rights) xin được lưu ý quý ngài về việc giam nhốt Blogger Lê Anh Hùng, mà hoạt động của ông nhằm thăng tiến tự do ngôn luận, quản lý tốt quốc gia và cải tiến dân chủ.

Ông Lê Anh Hùng bị sáu mật vụ bắt cóc lúc ông đang làm việc tại công ty ở Hưng Yên hôm 24.1.2013. Những người này không xuất trình bất cứ giấy tờ gì mà chỉ yêu cầu được gặp ông Lê Anh Hùng liên quan đến “Giấy tạm trú, tạm vắng”, rồi đưa lên xe chở đi mất. Sau đấy bạn bè ông mới biết ông bị đưa về Trung tâm Bảo trợ Xã hội số 2 ở Ứng Hòa gần Hà Nội, cơ sở những người mắc bệnh tâm thần. Trung tâm cho biết mẹ ông Hùng yêu cầu đưa ông về đây và không cho ai được tiếp xúc. Về sau mới biết là mẹ ông chẳng bao giờ có đơn xin giam nhốt như thế.

Đây không phải là lần đầu công an sách nhiễu ông Lê Anh Hùng, vốn thường xuyên bị bắt đi thẩm vấn, hăm dọa với đủ thứ hành vi sách nhiễu để trừng phạt các hành động đòi hỏi nhân quyền của ông Hùng.

Ba tổ chức chúng tôi lo lắng cho việc ông Lê Anh Hùng bị giam nhốt chiếu theo Pháp lệnh số 44 năm 2002 xử lý những vi phạm hành chính. Pháp lệnh quy định ở điều 1 khoản 3 rằng “cá nhân có hành vi vi phạm pháp luật về an ninh, trật tự, an toàn xã hội nhưng chưa đến mức truy cứu trách nhiệm hình sự” sẽ bị giam giữ không thông qua tòa án bằng việc “quản chế hành chính”, hoặc đưa vào “trường giáo dưỡng, cơ sở giáo dục, trại cải huấn, cơ sở chữa bệnh” (tức Bệnh viện tâm thần). LHQ không ngừng kêu gọi Việt Nam bãi bỏ Pháp lệnh 44 vì Pháp lệnh này trái chống với các điều được bảo đảm trong Công ước quốc tế về Các quyền dân sự và chính trị mà Việt Nam đã tham gia ký kết. Dù vậy, Việt Nam chẳng để ý đến các khuyến nghị của LHQ, tiếp tục áp dụng Pháp lệnh 44 với các nhà hoạt động ôn hòa cho nhân quyền. Năm ngoái, Blogger
Bùi Thị Minh Hằng từng bị giam giữ 5 tháng trong một “cơ sở giáo dục” ở Thanh Hóa trong những điều kiện vô cùng khắt nghiệt. Nhà hoạt động cho dân chủ Nguyễn Trung Lĩnh hiện bị giam nhốt tại Bệnh viện Tâm thần Trung ương ở Hà Nội.

Ba tổ chức chúng tôi lên án việc giam giữ trong bối cảnh đàn áp những nhà hoạt động Internet từ năm 2008, kể cả những vụ bắt bớ và giam giữ tùy tiện, mặc dù sự kiện vào tháng 6 năm 2012, Hội đồng Nhân quyền LHQ thông qua quyết nghị về Quyền tự do ngôn luận trên mạng điện tử phải được bảo đảm, đồng thời kêu gọi các quốc gia thành viên “thăng tiến và tạo điều kiện dễ dãi cho việc phát triển Internet”.
Vì vậy,
Đài Quan sát bảo vệ các Nhà bảo vệ Nhân quyềnỦy ban Bảo vệ Quyền Làm Người Việt Nam yêu cầu qúy Ngài :

- Trong mọi hoàn cảnh, bảo đảm sự toàn vẹn cho thân thể cũng như tâm lý của ông Lê Anh Hùng và mọi nhà hoạt động bảo vệ nhân quyền tại Việt Nam ;

- Trả tự do tức khắc và vô điều kiện cho ông Lê Anh Hùng hiện bị giam nhốt nhằm trừng phạt những hoạt động nhân quyền của ông ấy, trái chống với luật pháp quốc gia và quốc tế, đồng thời trả tự do cho tất cả các nhà hoạt động bảo vệ nhân quyền ;

- Chấm dứt mọi sách nhiễu đối với ông Lê Anh Hùng cũng như đối với mọi nhà hoạt động bảo vệ nhân quyền tại Việt Nam ;

- Tuân thủ Tuyên ngôn Quốc tế Bảo vệ Những người đấu tranh cho nhân quyền được Đại Hội đồng LHQ thông qua ngày 9.12.1998, đặc biệt :
- Điều 1 ấn định : “Mỗi người tự cá nhân mình hay liên hợp với những người khác, đều có quyến thăng tiến việc bảo vệ và thực hiện các quyền con người và các tự do căn bản trên bình diện quốc gia và quốc tế” ;
- Cũng như tại Điều 2 khoản 2 ấn định : “Quốc gia sử dụng mọi biện pháp cần thiết để theo dõi việc các nhà chức trách có thẩm quyển phải bảo vệ mọi người, khi các người này, tự cá nhân họ hay liên hợp với những người khác, trong khuôn khổ thi hành chính đáng các quyền mà bản tuyên ngôn này nhắm tới, chống lại các bạo động, đe dọa, hành động trả thù, phân biệt đối xử trong thực tế hay theo pháp lý, gây áp lực hoặc dùng các hành động võ đoán khác” ;
- Đại quan trong mọi hoàn cảnh, bảo đảm sự tôn trọng nhân quyền và các tự do cơ bản quy chiếu theo các Công ước nhân quyền quốc tế và khu vực đã được Việt Nam tham gia ký kết.

Re: Arbitrary internment of Le Anh Hung in “Social Support Centre No 2” Ung Hoa, Hanoi, January 24, 2013

Your Excellencies,

The Observatory for the Protection of Human Rights Defenders, a joint programme of the International Federation for Human Rights (FIDH) and the World Organisation Against Torture (OMCT), together with the Vietnam Committee on Human Rights (VCHR), wish to draw your attention to the internment of blogger Le Anh Hung, engaged in the promotion of freedom of expression, good governance and democratic reforms.

Mr. Le Anh Hung was kidnapped at his work place in Hung Yen on January 24, 2013 by six secret security agents. They failed to provide any document and pretexted to his boss that they needed to see him about “matters concerning temporary residence papers”, before forcing him into their car. Later, his friends discovered that he had been interned in “Social Support Centre No. 2” in Ung Hoa, Hanoi, a mental health institution. They were told that his mother had requested Le Anh Hung’s internment, and were denied the right to visit him. It later turned out that his mother had never made a request for his internment.

This is not the first time that police have harassed Le Anh Hung, who has been subjected to repeated interrogations, threats and other acts of harassment to sanction his human rights activities.

Our organisations fear that Le Anh Hung is detained under Ordinance 44 of 2002 on “Handling of Administrative Violations”. The ordinance provides that people who “commit acts of violating legislation on security, public order and safety, but not to the extent of penal liability” (Article 1.3) may be detained without trial for up to two years under house arrest (“probationary detention”), in “reformatories”, educational institutions, rehabilitation centres or “medical treatment establishments” (i.e. psychiatric hospitals). The United Nations has repeatedly called on Vietnam to abrogate Ordinance 44 on the grounds that it is inconsistent with the provisions of the UN International Covenant on Civil and Political Rights to which Vietnam is a state party. However, Vietnam has ignored these recommendations, and continues to implement it to detain peaceful activists. Blogger Bui Thi Minh Hang was detained for five months in an “education centre” in Thanh Hoa in 2011 under extremely harsh conditions. Pro-democracy activist Nguyen Trung Linh is interned in the Central Psychiatric Hospital in Hanoi.

Our organisations deplore that this internment takes place in the context of a crackdown targeting Internet activists since 2008, including arbitrary arrests and detentions, despite the fact that in June 2012, the UN Human Rights Council adopted a resolution affirming that the right to freedom of expression on-line must be protected, and called on States to “promote and facilitate access to the Internet”.

Therefore, the Observatory and VCHR respectfully ask your Excellencies to:

- Guarantee in all circumstances the physical and psychological integrity of Le Anh Hung as well as all human rights defenders in Vietnam;

- Release Le Anh Hung immediately and unconditionally as his internment seems to merely sanction his human rights activities and is contrary to national and international law as well as all other human rights defenders;

- Put an end to all acts harassment against Le Anh Hung as well as against all human rights defenders in Viet Nam;

- Comply with the provisions of the UN Declaration on Human Rights Defenders, adopted by the UN General Assembly on December 9, 1998, in particular:

- its Article 1, which states that “everyone has the right, individually and in association with others, to promote and to strive for the protection and realisation of human rights and fundamental freedoms at the national and international levels”,

- as well as Article 12.2, which provides that “the State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually and in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration”;
- More generally, ensure in all circumstances the respect for human rights and fundamental freedoms in accordance with international and regional human rights instruments ratified by Viet Nam.
