VRNs (January,
5, 2013) – Sài Gòn – On January 4th 2013, blogger Hoang-Vi Nguyen,
after discussing to lawyers, sent a document to denounce “the security forces
of Ho Chi Minh City, Dist. 1 and the police of Nguyen Cu Trinh Ward – Dist. No
1 of violating the Constitution and the Laws of the Socialist Republic of
Vietnam” to the authorities of HCM City and the Congressional delegation.
In the document, Ms Hoang-Vi Nguyen reported
violating acts of the Laws of the polices on December 28, 2012 which was the
day of the Appeal Hearing for three members of the Freelance Journalist Club.
For their violating the Laws Ms. Nguyen
suggested: “Agencies with authorities and jurisdiction to severely reprimand
the act which violated the Constitution and the Laws of the Socialist Republic
of Vietnam of responsible individuals and organization in the incident.”
Especially, she called upon “all concerned individuals and organizations to
look out for, help and speak out to defend me in this case in order for the
similar behaviours not to happen again to other citizens.”

I would like to present my case as follows:
1. Shortly after 8 am on 12/28/2012 when I
was sitting to relax at Bach Tung Diep park directly facing the People’s Court
HCM City, many uniformed police, urban order personnel and numerous
plain-clothes people demanded to have my identifications checked. They later
took me to the police station at Nguyen Cu Trinh Ward, 1st district.
2. In their squad car and at the station, the
plain-clothes policemen robbed my 2 phones and all my identification documents,
as well as my cash. They then beat me up savagely.
After beating me, they left me in a room to
confer with one another. When they returned, a plain-clothes security female
without a warrant ordered me to take off my clothes for a thourough body
search.
Since I would not comply, she and others
forced me down to strip off my clothes (except my underwear) while other male
officers observing.
Surprisingly enough, they videotaped my
ordeal of being stripped off with only my underwear on for quite a long time.
They then left me there to confer with one
another again. My physical being was not so good. I was in pain, fatigue,
drained.
My body became cold and shivering and I
started to vomit continuously while no one showed any regard.
After conferring, they returned to order my
clothes off for another body search. I still refused to comply. Four officers
then coerced me by force me to lie down on an office table, stripping what’s
left on my body. They- the female foursome- then held down my arms and legs to
search my private part while being observed by male security officers who
caused me to be in so much pain, both physically and mentally. In my pain and
suffering I could only scream out for help but these people showed no reaction.
After it was all done, the plain-clothes
security officers filed some sort of report without informing me of its
content. Meanwhile, a young female security officer from Dist. 1 told others
“Mr. Hai told us to do so”.
I suddenly recalled an incident in which Ms
Ta Phong Tan’s friends told me about Le Minh Hai’s wrong doings, up to and
including humiliating Ta Phong Tan just like what they did to me.
At little pass 12 pm, they brought me to
another station in Phu Thanh ward – Tan Phu dist. and detained me there until
almost 7 pm when they released me.
Having mentioned the above incidents, I
denounce the security forces of Ho Chi Minh City, Dist. 1 and the police of
Nguyen Cu Trinh Ward – Dist. No 1 of violating the Constitution and the Laws of
the Socialist Republic of Vietnam as follow:
- Kidnapped and arbitrarily detained me from
after 9:30 am until almost 7 pm on Dec 28, 2012
- Beat, tortured, and violated the right to
inviolability of my body, my honour and my dignity
Therefore, I suggest:
- Agencies with authorities and jurisdiction
to severely reprimand the act which violated the Constitution and the Laws of
the Socialist Republic of Vietnam of responsible individuals and organization
in the incident.
- Representative of the responsible agencies,
organizations to issue public apology and compensate me for the damage and harm
done on my health, spirit, honour and my dignity.
- Forces of public securities, police, civil
defence, urban order, and youth volunteers to stop arbitrary arrests, torture
and the use of corporal punishment on citizens.
- I call upon all concerned individuals and
organizations to look out for, help and speak out to defend me in this case in
order for the similar behaviours not to happen again to other citizens.
